sc 457 visa grandfathering arrangements are in place: Employers and employees who are currently using subclass 457 visas may be considering future options under the grandfathering arrangements and provisions.

We set out below some common visa pathways which may be available to you depending on your circumstances:

1. If you are currently using a subclass 457 visa or eligible bridging visa, you may wish to consider the following:

a. a subclass 482 visa;

b. a subclass 186 Employer Nomination Scheme visa or a subclass 187 Regional Sponsored Migration Scheme visa under the Temporary Residence Transition Stream if your subclass 457 visa was granted before 18 March 2018;

c. a subclass 186 Employer Nomination Scheme visa or a subclass 187 Regional Sponsored Migration Scheme visa under the Direct Entry stream.

2. If you are already using a subclass 482 visa or eligible bridging visa, you may wish to consider the following:

a. a subclass 186 Employer Nomination Scheme visa or a subclass 187 Regional Sponsored Migration Scheme visa under the Temporary Residence Transition Stream:

i. If your subclass 482 visa is for an occupation that is listed on the Medium and Long-term Strategic Skills List; or

ii. If your subclass 482 visa is for an occupation that is listed on the Short-term Skilled Occupation List and, on 18 April 2017, you held a subclass 457 visa or you were an applicant for a subclass 457 visa.  The two year (rather than new three year) work requirement will continue to apply to you;

b. a subclass 186 Employer Nomination Scheme visa or a subclass 187 Regional Sponsored Migration Scheme visa under the Direct Entry stream.
