What is an Overseas Business?

Overseas business can sponsor employees in Australia. An overseas business is defined as a business lawfully operating outside of Australia. The business can operate as an incorprated entitiy, partnership, trust or sole trader.

It must demonstrate intention to sponsor workers to establish Australian business or assist in fulfilling contractual obligation in Australia.

Particularly for overseas businesses, there are two excellent options to bring their workers to Australia.

The sc 400 visa is perfect for sponsoring employees on short term projects in Australia of up to 6 months and where you need to send your workers to Australia urgently (because the processing time is fairly quick by comparison to many other visas).

sc 482 visa - Overseas Business Sponsorship

The sc 482 visa (Temporary Skill Shortage visa) is available to overseas businesses. Overseas business can be approved as an overseas business sponsor in the same manner as Australian businesses if they are seeking approval to enable the sponsoring of their worker under the sc 482 visa scheme and if the worker will either:

  • Establish, or assist in establishing, on behalf of the overseas business, a business operation in Australia with overseas connections; or

  • Fulfil or assist in fulfilling a contractual obligation (in Australia) on behalf of the overseas business.
